ROBACH -- read twice and ordered printed, and when printed to be committed to the Committee on Finance -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT relating to making public television and radio stations eligible for funding under the state and municipal facilities program; and to amend chapter 54 of the laws of 2017, enacting the Capital Projects budget, in relation to including public television and radio stations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. For the state fiscal year 2017-18 and thereafter, public 2 television and radio stations shall be eligible for any monies appropri- 3 ated to the state and municipal facilities program for the payment of 4 capital costs. 5 § 2. That part, entitled "MISCELLANEOUS -- ALL STATE DEPARTMENTS AND 6 AGENCIES", of section 1 of chapter 54 of the laws of 2017, enacting the 7 "Capital Projects Budget", is amended by adding thereto the items here- 8 inbelow set forth in italic and is amended by deleting therefrom the 9 items hereinbelow set forth in brackets as follows: 10 STATE AND MUNICIPAL FACILITIES PROGRAM 11 CAPITAL PROJECTS 2017-18 12 APPROPRIATIONS REAPPROPRIATIONS 13 Capital Projects Funds - Other ..... 385,000,000 1,253,250,000 14 ---------------- ---------------- 15 All Funds ........................ 385,000,000 1,253,250,000 16 ================ ================ EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13150-02-7S. 6692--A 2 1 STATE AND MUNICIPAL FACILITIES PROGRAM (CCP) ............... 385,000,000 2 -------------- 3 Capital Projects Funds - Other 4 Capital Projects Fund 5 State and Municipal Facilities Purpose 6 For payment of the capital costs of 7 construction, improvement, rehabilitation 8 or reconstruction of facilities owned by 9 eligible entities; the acquisition of 10 capital facilities and assets by eligible 11 entities, including fixed capital assets; 12 the acquisition by eligible entities of 13 equipment and other capital assets, 14 including vehicles, in support of health, 15 safety, technology, or innovation; the 16 acquisition by an eligible entity of capi- 17 tal assets with a useful life of not less 18 than ten years purchased for the sole 19 purpose of preserving and protecting 20 infrastructure that is owned, controlled 21 or appurtenant to an eligible entity, 22 including but not limited to heavy duty 23 road maintenance and construction vehi- 24 cles, pavers, snow plows, street sweepers 25 and heavy duty fire, emergency response 26 and law enforcement vehicles; economic 27 development projects sponsored by the 28 state or municipal corporations, as 29 defined in section 2 of the general munic- 30 ipal law, that will create or retain jobs 31 in New York state as certified by the 32 commissioner of the department of economic 33 development; or environmental projects 34 sponsored by the state or municipal corpo- 35 rations as defined in section 2 of the 36 general municipal law. Eligible entities 37 shall consist of the state; municipal 38 corporations as defined in section 2 of 39 the general municipal law; water and sewer 40 districts; the Metropolitan Transportation 41 Authority; a college or university estab- 42 lished pursuant to section 352 of the 43 education law, section 6203 of the educa- 44 tion law or section 6302 of the education 45 law; an independent not-for-profit insti- 46 tution of higher education as defined in 47 subdivision 2 of section 6401 of the 48 education law; public school districts; 49 public housing authorities; public 50 libraries and library systems chartered by 51 the regents of the state of New York or 52 established by an act of the legislature; 53 public television and radio stations char- 54 tered by the regents of the state of NewS. 6692--A 3 1 York; public park conservancies or not for 2 profit corporations organized for the 3 purpose of investing in parks owned by the 4 state or municipal corporations, as 5 defined in section 2 of the general munic- 6 ipal law; not for profit fire districts, 7 fire commissions, fire companies, fire 8 departments, volunteer rescue and ambu- 9 lance squads; and special act school 10 districts, schools for the blind and deaf 11 and other students with disabilities 12 subject to article 85 of the education 13 law, and private schools for students with 14 disabilities authorized pursuant to chap- 15 ter 853 of the laws of 1976. 16 Costs may include, but shall not be limited 17 to engineering services, construction, 18 project management, right-of-way acquisi- 19 tion, and work appurtenant and ancillary 20 thereto. No funds from this appropriation 21 may be used as a required match or be 22 considered a local share to other state 23 programs or to leverage state aid or 24 grants including but not limited to the 25 apportionment of aid under the education 26 law. Notwithstanding any provision of law 27 to the contrary, funds appropriated herein 28 may, subject to the approval of the direc- 29 tor of the budget, be (i) interchanged, 30 (ii) transferred from this appropriation 31 to any other appropriation of any state 32 department, agency or public benefit 33 corporation, or (iii) suballocated to any 34 other state department, agency or public 35 benefit corporation, to achieve this 36 purpose (SM0117SM) ......................... 385,000,000 37 -------------- 38 § 3. This act shall take effect immediately; and shall be deemed to 39 have been in full force and effect on and after April 1, 2017.
