        Introduced  by  Sen.  SAVINO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes  --  recommitted  to
          the  Committee  on  Codes  in accordance with Senate Rule 6, sec. 8 --
          committee discharged, bill amended, ordered reprinted as  amended  and
          recommitted to said committee

        AN  ACT  to amend the civil rights law, in relation to excluding certain
          works and individuals from violations of the right of publicity

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph d of subdivision 2 of section 50-f of the civil
     2  rights law is amended by adding a new subparagraph v to read as follows:
     3    v. works identified pursuant to this paragraph shall not violate  this
     4  section, regardless of the medium or means of transmission.
     5    §  2.  Subdivisions  10, 11 and 12 of section 50-f of the civil rights
     6  law are renumbered subdivisions 11, 12 and 13 and a new  subdivision  10
     7  is added to read as follows:
     8    10.  Nothing  in  this  section  shall apply to a person that offers a
     9  service that displays, offers for sale or license, sells or  licenses  a
    10  work  of  art  or  other  visual  work,  or audiovisual work, to a user,
    11  provided the terms of such sale or license do not authorize such user to
    12  engage in acts that constitute a violation of this section.
    13    § 3. This act shall take effect immediately.
