        Introduced  by Sen. GAUGHRAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government

        AN ACT to amend the municipal home rule law, in relation to  local  laws
          adopted by towns subject to referendum on petition

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 1 of section 24 of the municipal home rule  law
     2  is amended by adding a new paragraph c to read as follows:
     3    c.  A local law adopted by a town and subject to a referendum on peti-
     4  tion as provided in this section or in any other state statute,  if  not
     5  also  subject  to a mandatory referendum shall be conducted as a permis-
     6  sive referendum as provided in article seven of the town law and compli-
     7  ance with such article shall be deemed to be compliance with this  chap-
     8  ter for all purposes.
     9    §  2.  Severability.  If  any provision of this act or the application
    10  thereof shall for any reason be  adjudged  by  any  court  of  competent
    11  jurisdiction  to  be invalid, such judgment shall not affect, impair, or
    12  invalidate the remainder of this act, but shall be confined in its oper-
    13  ation to the provision thereof directly involved in the  controversy  in
    14  which such judgment shall have been rendered.
    15    § 3. This act shall take effect immediately.
