STATE OF NEW YORK ________________________________________________________________________ 6619 2019-2020 Regular Sessions IN SENATE July 3, 2019 ___________ Introduced by Sen. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to authorizing the issuance of congenital heart disease awareness license plates; and to amend the state finance law, in relation to establishing the congenital heart disease research and education fund The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-ff to read as follows: 3 § 404-ff. Congenital heart disease awareness license plates. 1. Any 4 person residing in this state shall, upon request, be issued a distinc- 5 tive license plate in support of congenital heart disease awareness and 6 research bearing the phrase "Congenital Heart Disease Awareness" and any 7 other phrases and design approved by the commissioner. 8 2. An application for such license plate shall be filed with the 9 commissioner in such form and detail as the commissioner shall 10 prescribe. 11 3. A distinctive plate issued pursuant to this section shall be issued 12 in the same manner as other number plates upon the payment of the regu- 13 lar registration fee prescribed by section four hundred one of this 14 article; provided, however, that an additional annual service charge of 15 twenty-five dollars shall be charged for such plates. Such additional 16 annual service charge shall be deposited to the credit of the congenital 17 heart disease research and education fund established pursuant to 18 section ninety-nine-hh of the state finance law and shall be used for 19 the purposes specified in such section. 20 § 2. The state finance law is amended by adding a new section 99-hh to 21 read as follows: 22 § 99-hh. Congenital heart disease research and education fund. 1. 23 There is hereby established in the joint custody of the commissioner of EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13473-01-9S. 6619 2 1 taxation and finance and the comptroller a fund to be known as the 2 "congenital heart disease research and education fund". 3 2. Such fund shall consist of all revenues received pursuant to the 4 provisions of section four hundred four-ff of the vehicle and traffic 5 law and all other moneys appropriated, credited or transferred thereto 6 from any other fund or source pursuant to law. Nothing contained in this 7 section shall prevent the state from receiving grants, gifts or bequests 8 for the purposes of the fund as defined in this section and depositing 9 them into the fund according to law. 10 3. Moneys of the fund shall be expended only for congenital heart 11 disease research projects approved by the department of health in New 12 York state. As used in this section, the term "congenital heart disease 13 research and education projects" means scientific research into the 14 causes, prevention, screening, treatment and cure of congenital heart 15 disease. 16 4. Moneys shall be payable from the fund on the audit and warrant of 17 the comptroller on vouchers approved and certified by the commissioner 18 of health. 19 § 3. This act shall take effect on the ninetieth day after it shall 20 have become a law.
