        AN ACT to amend the state finance law, in relation to the direct deposit
          of certain salaries

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Paragraph (a) of subdivision 4 of section 200 of the state
     2  finance law, as amended by chapter 641 of the laws of 1997,  is  amended
     3  to read as follows:
     4    (a)  (i)  Upon  the  written request from a state employee hired on or
     5  before January first, two thousand  twenty-three,  the  comptroller  may
     6  cause, in accordance with the rules and regulations promulgated pursuant
     7  to paragraph (b) of this subdivision, such employee's net salary, or any
     8  portion  thereof designated by the employee, to be deposited directly in
     9  a bank for any purpose to an account in the name of  such  employee,  on
    10  forms  provided  by  the  comptroller, and duly filed in accordance with
    11  such regulations.
    12    (ii) On and after January first, two thousand twenty-three, the  comp-
    13  troller  shall  cause,  in  accordance  with  the  rules and regulations
    14  promulgated pursuant to paragraph  (b)  of  this  subdivision,  a  state
    15  employee's net salary to be deposited directly in a bank for any purpose
    16  to an account in the name of such employee, and into which such employee
    17  has  authorized  such  employee's  net  salary  be  deposited,  on forms
    18  provided by the comptroller, and duly  filed  in  accordance  with  such
    19  regulations.  Provided,  however, such employee may submit a request for

     1  exemption from the provisions of this subparagraph on a form provided by
     2  the comptroller.
     3    (iii)  The net salary of such state employee shall be paid in the form
     4  of a paper check until the employee provides the account information for
     5  a bank account in such  employee's  name  which  is  authorized  by  the
     6  employee  for  the  purpose  of  the direct deposit of his or her salary
     7  pursuant to this subdivision.
     8    (iv) Nothing set forth in  this  subdivision  shall  be  construed  to
     9  impede,  infringe  upon,  or  supersede  an  agreement providing for the
    10  payment of salaries between  the  state  and  an  employee  organization
    11  representing state officers and employees who are in positions which are
    12  in  collective  negotiating  units  pursuant  to article fourteen of the
    13  civil service law.
    14    § 2. This act shall take effect January 1, 2023 and shall  only  apply
    15  to  state employees hired on and after such date. Effective immediately,
    16  the adoption, amendment and/or repeal of any rule or  regulation  neces-
    17  sary  for  the  implementation  of  this  act  on its effective date are
    18  authorized to be made by the state comptroller on or before such date.
