        Introduced  by  Sen. TEDISCO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
        AN ACT authorizing the city of Schenectady to alienate  certain  parcels
          of  land  used  as  parkland  and  to acquire other parcels of land to
          replace such parkland
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the city of Schenec-
     2  tady,  acting by and through its governing body, is hereby authorized to
     3  discontinue as  parklands  and  alienate  the  lands  more  particularly
     4  described  in  section  three  of  this act, and to sell and convey such
     5  parklands at fair market value and upon such other terms and  conditions
     6  as  determined  by  the governing body of the city of Schenectady to the
     7  Boys & Girls Club for the purpose of constructing a  new  Boys  &  Girls
     8  Club facility at Quackenbush Park.
     9    § 2. The authorization contained in section one of this act shall take
    10  effect  only  upon  the  condition  that  the  city of Schenectady shall
    11  acquire and dedicate the lands described in section three of this act as
    12  additional parklands of the county.
    13    § 3. The lands authorized by section one of this act to be  discontin-
    14  ued  as parklands and conveyed to the Boys & Girls Club consists of 1.35
    15  acres and are described as follows:
    16    All that certain tract, piece, or parcel of land  situate,  lying  and
    17  being in the City of Schenectady, County of Schenectady and State of New
    18  York and being more particularly bounded and described as follows:
    19    Beginning at a point on the division line of lands herein described as
    20  Lot  1 on the south and lands now or formerly of Schenectady City School
    21  District as described in Liber 279 of deeds at page 209  on  the  north,
    22  said  point  being  the  northeast corner of Lot 2; thence running along
    23  said division line North 30°59'00" East, 150.10 feet to a point with the
    24  lands herein described as Lot 1 on the south, lands now or  formerly  of
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  Schenectady  City  School District on the west and lands now or formerly
     2  of the City of Schenectady as described in Liber 222 of  deeds  at  page
     3  479  on the east; thence South 53°08'09" East, 151.20 feet to a point on
     4  the  division  line  of  lands herein described as Lot 1 on the west and
     5  lands now or formerly of The City of Schenectady  on  the  east;  thence
     6  running  along said division line South 12°44'55" East, 195.16 feet to a
     7  point on the division line of lands herein described as  Lot  1  on  the
     8  north  and lands now or formerly of The City of Schenectady as described
     9  in Liber 302 of deeds at page 18 on the south; thence running along said
    10  division line South 78°47'04" West, 271.14 feet to a point at its inter-
    11  section with lands herein described as Lot 1 on the east, lands of Lot 2
    12  on the west and the lands now or formerly of The City of Schenectady  on
    13  the south; thence running along the division line of Lot 1 and Lot 2 the
    14  following  four  (4)  courses  and  distances: 1.) North 11°11'16" West,
    15  90.73 feet to a point; 2.) North 78°47'04" East, 42.99 feet to a  point;
    16  3.) North 11°12'56" West, 49.48 feet to a point; and 4.) North 09°19'00"
    17  East, 60.00 feet to the point or place of beginning.
    18    Containing 1.35 Acres of land more or less.
    19    §  4.  In  the event that the parklands to be dedicated by the city of
    20  Schenectady pursuant to this act are not equal to or  greater  than  the
    21  fair  market  value of the parkland to be discontinued and conveyed, the
    22  city of Schenectady shall dedicate the difference  of  the  fair  market
    23  value of the lands to be alienated and the lands to be dedicated for the
    24  acquisition  of  additional parklands and/or for capital improvements to
    25  existing park and recreational facilities.
    26    § 5. In the event that the city of Schenectady  received  any  funding
    27  support  or  assistance  from  the  federal government for the purchase,
    28  maintenance or improvement of the parklands set forth in  section  three
    29  of  this act, the discontinuance and alienation of such parkland author-
    30  ized by the provisions of this act shall not occur  until  the  city  of
    31  Schenectady has complied with any federal requirements pertaining to the
    32  alienation  or  conversion  of  such parklands, including satisfying the
    33  secretary of the interior that the  alienation  or  conversion  complies
    34  with  all conditions which the secretary of the interior deems necessary
    35  to assure the substitution of other lands shall be  equivalent  in  fair
    36  market value and usefulness to the lands being alienated or converted.
    37    § 6. This act shall take effect immediately.
