STATE OF NEW YORK ________________________________________________________________________ 6299 2021-2022 Regular Sessions IN SENATE April 21, 2021 ___________ Introduced by Sen. BENJAMIN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the executive law, in relation to prohibiting the invol- untary use of sedatives during an arrest The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Clause (viii) of subparagraph 2 of paragraph (d) of subdi- 2 vision 4 of section 840 of the executive law, as added by section 1 of 3 part ZZ of chapter 55 of the laws of 2019, is amended to read as 4 follows: 5 (viii) prohibited uses of force, including but not limited to, admin- 6 istering or directing the administration of a sedative during the arrest 7 of an individual without the consent of such individual. 8 § 2.
