BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to legalize, validate, ratify and confirm the abolition of the offices of fire commissioners by the town of Deposit, in the county of Delaware; and providing for the repeal of such provisions upon expira- tion thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any provision of the town law or insurance 2 law, all proceedings and actions taken by the town of Deposit in the 3 county of Delaware, in relation to the abolition of the offices of fire 4 commissioners and transfer of their functions to the town board and town 5 supervisor, including executing contracts for fire protection, redis- 6 tributing foreign fire insurance premium tax funds and the establishment 7 of any account of funds from real property taxes of the fire district, 8 are hereby legalized, validated, ratified and confirmed. 9 S 2. Notwithstanding the defects described in section one of this act, 10 the town board of the town of Deposit is hereby authorized to initiate 11 proceedings pursuant to article 17-A of the general municipal law to 12 dissolve the offices of fire commissioners as if the town board were the 13 governing body of the offices of fire commissioners. 14 S 3. This act shall take effect immediately and shall expire and be 15 deemed repealed on July 1, 2013.
