       AN ACT in relation to  the  management  and  conservation  of  horseshoe
         crabs; and providing for the repeal of such provisions upon expiration
         thereof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. As part of the management and conservation measures author-
    2  ized under subdivision 7 of section 13-0331 of the environmental conser-
    3  vation law as pertains to horseshoe crabs, the  department  of  environ-
    4  mental conservation shall consider the following:
    5    (a) the use of bait bags in whelk pots;
    6    (b)  the impacts of establishing seasons during spawning and nonspawn-
    7  ing seasons;
    8    (c) the impacts of establishing harvest limits based on sex; and
    9    (d) ecologically based consideration of harvest limits and  quotas  to
   10  include  factors  such  as  shore  bird consumption based on information
   11  collected and used by the Atlantic States Marine Fishery Commission.
   12    S 2. This act shall take effect immediately and shall  expire  and  be
   13  deemed repealed December 31, 2017.
