          twice and ordered printed, and when printed to  be  committed  to  the
          Committee on Consumer Protection

        AN  ACT to amend the general business law, in relation to the suspension
          of a health club contract

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The general business law is amended by adding a new section
     2  624-a to read as follows:
     3    §  624-a.  Rights  of  suspension  of  contracts  for  services. Every
     4  contract for services at a health club, which is premised upon  the  use
     5  of  such  health  club's facility or premises, and where the use of such
     6  facility or premises (1) has ceased, partially or fully,  (2)  has  been
     7  rendered impossible or illegal, or (3) where the non-use of the facility
     8  or premises, or the non-rendering of service, has frustrated the purpose
     9  of  the  contract,  shall provide the buyer, at the option of the health
    10  club, the right to suspend payment for all services until access to  the
    11  facility  or premises is restored, or the right to a credit for dues and
    12  fees paid.
    13    § 2. This act shall take effect immediately.
