BROOKS, BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- recommitted to the Committee on Cultural Affairs, Tourism, Parks and Recreation in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the navigation law, in relation to requiring working marine carbon monoxide detectors to be carried on closed bow boats The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 40 of the navigation law is amended by adding a new 2 subdivision 9-a to read as follows: 3 9-a. Marine carbon monoxide detectors. 4 (a) For the purposes of this section, a marine carbon monoxide 5 detection system shall mean a device or system that meets the require- 6 ments of the current version of the American Boat and Yacht Council 7 Standard A-24, for carbon monoxide detection systems. 8 (b) No vessel that has an enclosed accommodation compartment may be 9 operated on any navigable waters of the state unless such vessel is 10 equipped with a functioning marine carbon monoxide detection system 11 appropriate for such vessel and according to the manufacturer's instruc- 12 tion. For the purpose of this section, an "enclosed accommodation 13 compartment" means one contiguous space, surrounded by boat structure 14 that contains all of the following: 15 (i) designated sleeping accommodations; 16 (ii) a galley area with sink; and 17 (iii) a head compartment. 18 (c) After the effective date of this subdivision, no new vessel that 19 has an enclosed accommodation compartment may be sold or offered for EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the one hundred eightieth day after 5 it shall have become a law.
