PALUMBO -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT to authorize the Mattituck park district, in the town of Sout- hold, county of Suffolk, to discontinue use of certain lands as park- lands and sell such lands, and to use proceeds for capital improve- ments to existing park facilities in the Mattituck park district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The Mattituck park district, in the town of Southold, coun- 2 ty of Suffolk, is hereby authorized to discontinue use of certain park- 3 lands more particularly described in section three of this act which are 4 no longer useful for park purposes, and sell and convey such district 5 parklands in fee simple for its fair market value and upon such terms 6 and conditions as it deems appropriate, subject to the provisions of 7 section 4 of chapter 924 of the laws of 1941. 8 S 2. The authorization contained in section one of this act shall 9 take effect only upon the condition that the Mattituck park district 10 dedicated an amount equal to or greater than the fair market value of 11 the property being alienated in section three of this act toward acqui- 12 sition of additional parkland and/or capital improvements to existing 13 parkland within the district. The lands authorized by section one of this act to be discontin- 2 ued as parklands, and to be sold and conveyed are as follows: 3 ALL that certain plot, piece or parcel of land, situate, lying and 4 being at Mattituck, in the Town of Southold, County of Suffolk and State 5 of New York, being bounded and described as follows: 6 BEGINNING at a point on the southwesterly side of Love Lane distant 7 60.00 feet northwesterly from the corner formed by the intersection of 8 the northwesterly side of Middle Road with the southwesterly side of 9 Love Lane; 10 RUNNING THENCE South 53 degrees 30 minutes West, 115.00 feet to the 11 northeast corner of land now or formerly of Abrahams; 12 THENCE North 36 degrees 30 minutes West, 33 feet to other land now or 13 formerly of Mattituck Park District; 14 THENCE North 53 degrees 30 minutes East along said land now or former- 15 ly of Mattituck Park District and land now or formerly of Michael Peri- 16 volaris and Kathy Perivolaris, 115.00 feet to the southwesterly side of 17 Love Lane; 18 THENCE South 36 degrees 30 minutes East along the southwesterly side 19 of Love Lane, 33 feet to the point or place of BEGINNING, containing 20 .087 acre of land. 21 S 4. In the event the Mattituck park district received any funding 22 support or assistance from the federal government for the purchase, 23 maintenance or improvement of the parklands set forth in section three 24 of this act, the discontinuance and conveyance of parkland authorized by 25 the provisions of this act shall not occur until the Mattituck park 26 district has complied with any federal requirements pertaining to the 27 alienation or conversion of parklands, including satisfying the secre- 28 tary of the interior that the alienation or conversion complies with all 29 conditions which the secretary of the interior deems necessary to assure 30 the substitution of other lands shall be equivalent in fair market value 31 and recreational usefulness to the lands being alienated or converted. 32 S 5. This act shall take effect immediately.
