NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the town of Waterloo, county of Seneca to alienate and convey certain parcels of land used as parkland THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The town of Waterloo, in the county of Seneca, acting 2 through its town board, is hereby authorized to discontinue and alienate 3 certain parklands more particularly described in section three of this 4 act and sell and convey in fee simple for its fair market value and upon 5 such terms and conditions as determined by the town board. 6 S 2. The authorization contained in section one of this act shall take 7 effect only upon the condition that the town of Waterloo dedicate an 8 amount equal to or greater than the fair market value of the property 9 being alienated in section three of this act toward acquisition of addi- 10 tional parkland and/or capital improvements to existing parkland. 11 S 3. The lands to be discontinued as parklands and alienated and 12 conveyed pursuant to section one of this act are bounded and described 13 as follows: 14 ALL THAT TRACR OR PARCEL OF LAND, situate in the Town of Waterloo, 15 County of Seneca and State of New York, bounded and described as 16 follows: Premises described as "Park" on a map of Broadway Heights 17 filed in the Seneca County Clerk's Office on June 25, 1956 in Map Book 18 26 at page 20. Said premises are bounded on the north by Routes 5 & 20, 19 on the west by East Avenue, on the east by the east line of Broadway 20 Heights as shown on said map and on the south by Lot 52 as shown on said 21 map. 22 Being the same premises as conveyed to Frederick C. Snyder by Laverne 23 M. Sessler by Deed dated November 16, 2000 and recorded in the Seneca 24 County Clerk's Office on May 8, 2001 in Liber 624 of Deeds at page 299. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10944-01-5 S. 5590 2 1 The above-described premises are more recently and particularly 2 described and set forth on a survey map entitled "Lands of Frederick C. 3 Snyder" prepared by Charles E. Carroll on November 21, 2006 as follows: 4 BEGINNING at a nail on the S line of Rte 5 & 20 at its intersection 5 with the E line of East Avenue; thence N 74 22' 00" E a distance of 6 61.90' to a nail on said S line; thence S 07 55' 00" E a distance of 7 150.00' to an IP; thence S 81 26' 00" W a distance of 147.91' to a 8 point on the E line of East Avenue; thence N 08 34' 00" W a distance of 9 43.38' to an IP on said E line; thence with a curve turning to the right 10 with an arc length of 144.93', with a radius of 100.00', with a chord 11 bearing of N 33 07' 37" E, with a chord length of 132.57', to a nail on 12 said S line; which is the point of beginning having an area of 19325.84 13 square feet, 0.444 acres. 14 S 4. In the event that the town of Waterloo received any funding 15 support or assistance from the federal government for the purchase, 16 maintenance or improvement of the parklands set forth in section three 17 of this act, the discontinuance and conveyance of parkland authorized by 18 the provisions of this act shall not occur until the town of Waterloo 19 has complied with any federal requirements pertaining to the alienation 20 or conversion of parklands, including satisfying the secretary of the 21 interior that the alienation or conversion complies with all conditions 22 which the secretary of the interior deems necessary to assure the 23 substitution of other lands shall be equivalent in fair market value and 24 recreational usefulness to the lands being alienated or converted. 25 S 5. This act shall take effect immediately.
