        Introduced  by  Sen.  RIVERA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Disabilities --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee

        AN  ACT  to  amend the public health law, in relation to blanket service
          limits in the early intervention program

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  public health law is amended by adding a new section
     2  2559-c to read as follows:
     3    § 2559-c. Blanket service limits prohibited.  The  commissioner  shall
     4  not  impose  predetermined  limitations,  including  limitations  on the
     5  length, duration, frequency, intensity, method of delivery, group  size,
     6  or  staff  ratios,  on authorized services under this title. The commis-
     7  sioner shall not impose program-wide service limitations  that  restrict
     8  the  ability of an individualized family services plan team to create an
     9  individualized plan of early intervention services most  appropriate  to
    10  accommodate the needs of each child and family.
    11    § 2. This act shall take effect immediately.
