STATE OF NEW YORK ________________________________________________________________________ 5343 2019-2020 Regular Sessions IN SENATE April 26, 2019 ___________ Introduced by Sen. KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the environmental conservation law, in relation to prohibiting the use of chlorpyrifos; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 33-1301 of the environmental conservation law is 2 amended by adding a new subdivision 12 to read as follows: 3 12. Effective January first, two thousand twenty, for any person to 4 use chlorpyrifos by aerial application. 5 § 2. Section 33-1301 of the environmental conservation law is amended 6 by adding a new subdivision 12 to read as follows: 7 12. Effective January first, two thousand twenty-one, for any person 8 to apply chlorpyrifos other than to apple tree trunks. 9 § 3. Section 33-1301 of the environmental conservation law is amended 10 by adding a new subdivision 12 to read as follows: 11 12. For any person to use chlorpyrifos. 12 § 4. This act shall take effect immediately; provided, however, that 13 section one of this act shall expire and be deemed repealed January 1, 14 2021 when upon such date the provisions of section two of this act shall 15 take effect; provided further, however, that section two of this act 16 shall expire and be deemed repealed December 1, 2021 when upon such date 17 the provisions of section three of this act shall take effect.
