          printed to be committed to the Committee on Codes
        AN ACT to amend the penal law, in relation to the promotion of prostitu-
          tion
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Section 230.15 of the penal law is amended by adding a new
     2  subdivision 3 to read as follows:
     3    3. "Promote prostitution." A person "promotes prostitution" when he or
     4  she  knowingly, issues, gives, mails, distributes or transmits any writ-
     5  ten material or electronic communication which advertises the  provision
     6  of sexual conduct in return for a fee.
     7    § 2. Section 230.20 of the penal law, as amended by chapter 215 of the
     8  laws of 2011, is amended to read as follows:
     9  § 230.20 Promoting prostitution in the fourth degree.
    10    A person is guilty of promoting prostitution in the fourth degree when
    11  he or she knowingly:
    12    1. Advances, promotes or profits from prostitution; or
    13    2.  With  intent  to  advance,  promote  or  profit from prostitution,
    14  distributes or disseminates to ten or more  people  in  a  public  place
    15  obscene  material, as such terms are defined by subdivisions one and two
    16  of section 235.00 of this title, or material  that  depicts  nudity,  as
    17  such term is defined by subdivision one of section 245.10 of this part.
    18    Promoting prostitution in the fourth degree is a class [A misdemeanor]
    19  E felony.
    20    § 3. This act shall take effect on the first of November next succeed-
    21  ing the date on which it shall have become a law.
