STATE OF NEW YORK ________________________________________________________________________ 4864 2021-2022 Regular Sessions IN SENATE February 16, 2021 ___________ Introduced by Sen. GAUGHRAN -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to audits by the Long Island power authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 2 of subdivision (bb) of section 1020-f of the 2 public authorities law, as amended by section 7 of part A of chapter 173 3 of the laws of 2013, is amended to read as follows: 4 2. The department of public service shall notify the authority that 5 said department is in the process of initiating a comprehensive manage- 6 ment and operations audit as described in paragraph one of this subdivi- 7 sion in a manner that ensures the timeliness of such audit, and in 8 accordance with the following timeframe: the first comprehensive manage- 9 ment and operations audit shall be initiated as of the effective date of 10 chapter eight of the laws of two thousand twelve and undertaken in a 11 manner and to an extent that is practicable in the context of the 12 authority's transition to a new management service structure; the second 13 comprehensive management and operations audit shall be initiated no 14 later than December fifteenth, two thousand sixteen; and all additional 15 comprehensive management and operations audits shall be initiated at 16 least once every [five] three years thereafter. Within a reasonable time 17 after such notification to the authority, said department or the inde- 18 pendent auditor retained by the authority to undertake such audit shall 19 hold public statement hearings, with proper notice, in both Nassau and 20 Suffolk counties for the purpose of receiving both oral and written 21 comments from the public on matters related to such audit as described 22 in paragraph one of this subdivision. 23 § 2.
