        Introduced  by  Sen.  PARKER -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
        AN ACT to amend the real property tax  law,  in  relation  to  exempting
          property  owners  from  tax  increases  when  installing a wind energy
          system on or after January 1, 2021
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Subdivision 5 of section 487 of the real property tax law,
     2  as amended by chapter 325 of the laws of 2018, is  amended  to  read  as
     3  follows:
     4    5. The exemption granted pursuant to this section shall only be appli-
     5  cable  to  (a) solar or wind energy systems or farm waste energy systems
     6  which are (i) existing or constructed  prior  to  July  first,  nineteen
     7  hundred  eighty-eight  or  (ii) constructed subsequent to January first,
     8  nineteen hundred ninety-one and prior to  January  first,  two  thousand
     9  twenty-five,  [and]  (b)  micro-hydroelectric  energy systems, fuel cell
    10  electric generating systems, micro-combined heat  and  power  generating
    11  equipment  systems, electric energy storage equipment or electric energy
    12  storage system, or fuel-flexible linear  generator  electric  generating
    13  system  which  are constructed subsequent to January first, two thousand
    14  eighteen and prior to January first, two thousand twenty-five,  and  (c)
    15  wind  energy  systems constructed on residential, commercial or agricul-
    16  tural property on or after January first, two thousand twenty-one.
    17    § 2. This act shall take effect immediately; provided, however that if
    18  chapter 325 of the laws of 2018 shall not  have  taken  effect  on    or
    19  before  such  date then section one of this act shall take effect on the
    20  same date and in the same manner as such chapter of the  laws  of  2018,
    21  takes effect.
