STATE OF NEW YORK ________________________________________________________________________ 3263 2021-2022 Regular Sessions IN SENATE January 28, 2021 ___________ Introduced by Sens. COMRIE, RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Author- ities and Commissions AN ACT to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the business enterprise was unsuccessful in obtaining the contract The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Clause IV of subparagraph (H) of paragraph (j) of subdivi- 2 sion 3 of section 2879 of the public authorities law, as added by chap- 3 ter 174 of the laws of 2010, is amended and a new subparagraph (I) is 4 added to read as follows: 5 IV. consult the most recent disparity study pursuant to article 6 fifteen-A of the executive law[.]; and 7 (I) A requirement that, within thirty days of the awarding of a 8 contract, the corporation awarding the contract provide notice to each 9 minority- or women-owned business enterprise that unsuccessfully bid on 10 the contract of the reason or reasons why the business enterprise was 11 unsuccessful in obtaining the contract. 12 § 2. Section 143 of the economic development law is amended by adding 13 a new subdivision 6 to read as follows: 14 6. Within thirty days of the awarding of a contract, the agency award- 15 ing the contract shall provide notice to each minority- or women-owned 16 business enterprise that unsuccessfully bid on the contract of the 17 reason or reasons why the business enterprise was unsuccessful in 18 obtaining the contract. 19 § 3.
