BROUK, BIAGGI, GAUGHRAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the penal law, in relation to coercion in the third degree The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The first undesignated paragraph of section 135.60 of the 2 penal law, as amended by section 1 of part NN of chapter 55 of the laws 3 of 2018, is amended to read as follows: 4 A person is guilty of coercion in the third degree when he or she 5 compels or induces a person to engage in conduct which the latter has a 6 legal right to abstain from engaging in, or to abstain from engaging in 7 conduct in which he or she has a legal right to engage, or compels or 8 induces a person to join a group, organization or criminal enterprise 9 which such latter person has a right to abstain from joining, or compels 10 or induces a person to produce, disseminate, or otherwise display an 11 image or images depicting nudity of such person or depicting such person 12 engaged in sexual conduct as defined in subdivisions two and three of 13 section 235.20 of this chapter, by means of instilling in him or her a 14 fear that, if the demand is not complied with, the actor or another 15 will: 16 § 2.
