Section 201-a of the executive law is amended by adding a 2 new subdivision 10 to read as follows: 3 10. The office of general services shall, on or before December thir- 4 ty-first, two thousand twenty-two, prepare, in consultation with the 5 department of environmental conservation and the New York state energy 6 research and development authority, a state fleet procurement plan for 7 purchase or lease of state agency vehicles to ensure that (i) at least 8 twenty-five percent of state agency vehicles, including ten percent of 9 state agency medium and heavy duty vehicles, will be zero emission vehi- 10 cles by no later than December thirty-first, two thousand twenty-five 11 and (ii) at least fifty percent of state agency vehicles, including 12 twenty-five percent of state agency medium and heavy duty vehicles, will 13 be zero emission vehicles by no later than December thirty-first, two 14 thousand thirty. LBD06578-08-2S. 2838--C 2 1 sion vehicles by no later than December thirty-first, two thousand thir- 2 ty-five, and all state agency medium and heavy duty vehicles shall be 3 zero emission vehicles by no later than December thirty-first, two thou- 4 sand forty, unless a zero emission vehicle is not feasible for a partic- 5 ular application. By January first, two thousand thirty, all passenger 6 vehicles purchased by or for the state or any agency or public authority 7 thereof shall be zero emission vehicles. By January first, two thousand 8 thirty-five, all medium and heavy duty vehicles purchased by or for the 9 state or any agency or public authority thereof shall be zero emission 10 vehicles where feasible. For purposes of this subdivision, "zero emis- 11 sion vehicle" shall mean a vehicle powered by means of a battery or fuel 12 cell or a combination thereof, or another source of power, that produces 13 zero exhaust emissions of any greenhouse gas, criteria pollutant or 14 precursor pollutant under any and all possible operational modes and 15 conditions. 16 § 2. This act shall take effect immediately.
