        AN ACT to amend the state finance law, in relation to  establishing  the
          New York state youth sports initiative grants fund

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The state finance law is amended by adding  a  new  section
     2  99-qq to read as follows:
     3    §  99-qq.  New  York  state  youth sports initiative grants fund. 1. A
     4  special fund to be known as the "New York state youth sports  initiative
     5  grants  fund"  is  hereby  established in the custody of the state comp-
     6  troller and the commissioner of children and family services.
     7    2. The fund shall consist of all monies appropriated for its  purpose,
     8  all monies transferred to such fund pursuant to law, all monies required
     9  by this section or any other provision of law to be paid into or credit-
    10  ed  to  the  fund  and  any  interest earnings which may accrue from the
    11  investment of monies in the fund. Nothing contained herein shall prevent
    12  the comptroller or commissioner of children  and  family  services  from
    13  receiving  grants,  gifts  or  bequests  for the purposes of the fund as
    14  defined in this section and depositing them into the fund  according  to
    15  law.
    16    3.  Monies  of  the  fund,  when allocated, shall be available to make
    17  grants to eligible not-for-profit youth sports organizations.   Not-for-
    18  profit youth sports organizations shall be chosen by the commissioner of
    19  children  and  family  services for such grants based on criteria estab-
    20  lished by the commissioner of children  and  family  services  for  such
    21  purpose.

     1    4.  Monies  shall be payable from the fund on the audit and warrant of
     2  the comptroller on vouchers approved and certified by  the  commissioner
     3  of children and family services.
     4    5.  The  commissioner of children and family services shall promulgate
     5  any rules and regulations necessary to carry out the provisions of  this
     6  section.
     7    6.  Additionally,  the  commissioner  of  children and family services
     8  shall submit a report to the governor, the temporary  president  of  the
     9  senate  and the speaker of the assembly, prior to, but in no event later
    10  than, December thirty-first, in the year following the effective date of
    11  this section, and annually thereafter, which shall include, but  not  be
    12  limited to:
    13    (a) financial reports of the grants fund operations established pursu-
    14  ant to this section;
    15    (b)  an  analysis  of  the grants fund's ability to provide such youth
    16  sports initiative grants;
    17    (c) recommendations on the continuation of such grants  and  the  need
    18  for fund expansion, if appropriate;
    19    (d) profiles of the grant recipients; and
    20    (e)  other  information deemed necessary by the commissioner of educa-
    21  tion.
    22    7. (a) No applicant for a grant provided for under this section  shall
    23  knowingly:  (i)  make  a  false statement or representation concerning a
    24  material fact; (ii) submit false information concerning a material fact;
    25  or (iii) conceal a material fact, on an application to  obtain  a  grant
    26  provided for under this section.
    27    (b)  Any  applicant  who  is found by the commissioner of children and
    28  family services, after notice and an  administrative  hearing,  to  have
    29  received  a grant provided for under this section based upon an applica-
    30  tion which violated paragraph (a) of this subdivision shall  be  subject
    31  to a civil penalty not to exceed two hundred fifty dollars.
    32    § 2. This act shall take effect immediately.
