MORAHAN, DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to certain independent medical examinations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 137 of the workers' compensation law is amended by 2 adding a new subdivision 12 to read as follows: 3 12. IF A PRACTITIONER SHALL FIND NO DISABILITY WHILE PERFORMING AN 4 INDEPENDENT MEDICAL EXAMINATION THEN SUCH PRACTITIONER, OR ANOTHER 5 MEMBER OF A PREFERRED PROVIDER ORGANIZATION OR MANAGED CARE PROVIDER TO 6 WHICH THE PRACTITIONER BELONGS, IS NOT ELIGIBLE TO PERFORM ANY SUBSE- 7 QUENT INDEPENDENT MEDICAL EXAMINATION OF THE CLAIMANT FOR THE ORIGINAL 8 CLAIM OR ANY NEW CLAIM. 9 S 2.
