        AN  ACT  to  amend  the  general  business law, in relation to requiring
          internet service providers to charge a  residential  rate  to  certain
          emergency service organizations

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The general business law is amended by adding a new article
     2  40 to read as follows:
     3                                 ARTICLE 40
     4                         INTERNET SERVICE PROVIDERS
     5  Section 900. Definitions.
     6          901. Rates for emergency service organizations.
     7    § 900. Definitions. For the purpose of this  article:    1.  "Internet
     8  service  provider"  means any person, business or organization qualified
     9  to do business in this state that provides individuals, corporations, or
    10  other entities with the ability  to  connect  to  the  internet  through
    11  equipment that is located in this state.
    12    2.  "Emergency service organization" means any voluntary fire or ambu-
    13  lance company.
    14    § 901. Rates for emergency service organizations. No internet  service
    15  provider shall charge any emergency service organization an amount which
    16  is  more than the rate charged to residential customers of such internet
    17  service provider. When such internet service provider charges  different
    18  rates  for  business  customers  and  residential  customers,  emergency
    19  service organizations shall be charged the residential rate.    Notwith-
    20  standing  the  charging of a residential rate, service provided to emer-

     1  gency service organizations shall be provided at the  level  of  service
     2  provided by such internet service provider to business customers.
     3    §  2.  This  act shall take effect on the thirtieth day after it shall
     4  have become a law.
