SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to allowing a board of education to require minors who are five years of age to attend kindergarten The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph c of subdivision 2 of section 3205 of the educa- 2 tion law, as amended by chapter 277 of the laws of 2017, is amended to 3 read as follows: 4 c. The board of education [of the Syracuse city school district, the5board of education of the city school district of the city of New York,6the board of education of the city school district of the city of7Rochester, the board of education of the city school district of the8city of Utica, the board of education of the city school district of the9city of Buffalo the board of education of the city school district of10the city of Cohoes, the board of education of the city school district11of the city of Watervliet, and the board of education of the city school12district of the city of Yonkers are] of every school district within the 13 state is hereby authorized to require minors who are five years of age 14 on or before December first to attend kindergarten instruction. However, 15 the provisions of this paragraph shall not apply to: 16 (i) Minors whose parents elect not to enroll their children in school 17 until the following September. 18 (ii) Students enrolled in non-public schools or in home instruction. 19 § 2.
