        AN  ACT  to  amend  the  administrative code of the city of New York, in
          relation to the method of payment on delinquent real  property  taxes,
          sewer  rents, sewer surcharges, water rents, or any other charges that
          are made a lien
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Paragraph  2  of  subdivision  b of section 11-322 of the
     2  administrative code of the city of New York, as  amended  by  local  law
     3  number  4  of the city of New York for the year 2017, is amended to read
     4  as follows:
     5    2. An installment agreement shall provide for payments by the property
     6  owner, or other eligible person acting on behalf of an owner, on a quar-
     7  terly or monthly basis, for a period not less than eight years  and  not
     8  more  than  ten years, provided that a property owner, or other eligible
     9  person acting on behalf of an owner, may elect a period less than  eight
    10  years.  Except  as  provided in paragraph one of this subdivision, there
    11  shall be no down payment required upon the  property  owner's,  or  such
    12  other  eligible  person's,  entering into the installment agreement with
    13  the respective department, but the property  owner,  or  other  eligible
    14  person  acting  on behalf of an owner, may elect to make a down payment.
    15  With respect to installment agreements with the commissioner of environ-
    16  mental protection, the determination of whether payments shall be  on  a
    17  quarterly  or  monthly basis shall be in the discretion of• such commis-
    18  sioner, except as provided in paragraph three of this subdivision.  With
    19  respect  to installment agreements with the commissioner of finance, the
    20  determination of whether payments shall be on  a  quarterly  or  monthly

     1  basis  shall be in the discretion of the property owner, or other eligi-
     2  ble person acting on behalf of an owner.   Any payment by  the  property
     3  owner  pursuant  to  such an agreement must be made by cash, debit card,
     4  credit card, certified check or by money order. A payment by an eligible
     5  person  pursuant  to  such an agreement may be made by personal check to
     6  the respective department, provided however that if such property  shall
     7  be  subject to a lien sale pursuant to section 11-319 of this chapter it
     8  must be made to the respective department seven business days  prior  to
     9  such sale.
    10    § 2. This act shall take effect immediately.
