          printed to be committed to the Committee on Cities
        AN ACT to amend the administrative code of the  city  of  New  York,  in
          relation to the removal of raccoons
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1.  The administrative code of the city of New York is amended
     2  by adding a new section 17-198.1 to read as follows:
     3    § 17-198.1 Raccoon removal. a. The department shall ensure the  prompt
     4  removal  of any raccoon from any outdoor public or private property upon
     5  receiving notice from a member of the public that a raccoon or  raccoons
     6  have created a nuisance at such property.
     7    b. The department shall coordinate the humane release of raccoons with
     8  the  department  of  parks  and recreation, provided that the department
     9  deems the release poses no threat to public health or safety, in accord-
    10  ance with the rules of the department.  In conjunction with the  depart-
    11  ment  of  parks  and  recreation,  the department shall also establish a
    12  program to spay or neuter all raccoons captured pursuant to this section
    13  prior to their humane release.
    14    c. The department shall promulgate such rules as may be  necessary  to
    15  implement the provisions of this section.
    16    § 2. This act shall take effect immediately.
