          mental Disabilities
        AN ACT to amend the mental hygiene law, in relation to notice of  trans-
          fer of sex offender to community program or residence
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 13.09 of the  mental  hygiene  law  is  amended  by
     2  adding a new subdivision (i) to read as follows:
     3    (i)  The  commissioner shall notify the chief executive officer of any
     4  municipality where a sex offender, as defined  pursuant  to  subdivision
     5  one  of  section  one  hundred  sixty-eight-a  of the correction law, is
     6  transferred to a community program or residence within his or her  muni-
     7  cipality.  The  commissioner  shall  also  notify  the superintendent of
     8  schools in which such facility is located.  Notice  shall  be  given  no
     9  later than ten calendar days prior to such transfer.
    10    § 2. This act shall take effect immediately.
