STATE OF NEW YORK ________________________________________________________________________ 518--A 2021-2022 Regular Sessions IN SENATE (Prefiled) January 6, 2021 ___________ Introduced by Sens. KAPLAN, BROOKS, THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Elections -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the election law, in relation to the number of polling sites for early voting in certain counties The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 2 of section 8-600 of the 2 election law, as amended by chapter 74 of the laws of 2021, is amended 3 to read as follows: 4 (a) The board of elections shall designate polling places for early 5 voting, which may include the offices of the board of elections, for 6 persons to vote early pursuant to this title; provided, however, that 7 the municipality with the highest population in each county based on the 8 latest federal decennial census, or the county seat in Washington coun- 9 ty, shall have at least one polling place designated for early voting, 10 and to the extent practicable if such municipality has public transpor- 11 tation routes, such polling place shall be situated along such transpor- 12 tation routes. There shall be so designated at least one early voting 13 polling place for every full increment of fifty thousand registered 14 voters in each county; provided, however, the number of early voting 15 polling places in a county shall not be required to be greater than ten 16 unless required by any other provision of law, and provided further that 17 a county with fewer than fifty thousand voters shall have at least one 18 early voting polling place; and provided further that in counties with a 19 population of one million two hundred fifty thousand or more based on 20 the latest federal decennial census, but outside cities with a popu- 21 lation of one million or more based on the latest federal decennial 22 census, each town and city in such counties shall have at least one 23 polling place. 24 § 2.
