Paragraph (g) of subdivision 3 of section 385 of the vehi- 2 cle and traffic law is relettered paragraph (h) and a new paragraph (g) 3 is added to read as follows: 4 (G) THE LENGTH OF A SPECIALIZED MATERIAL DELIVERY VEHICLE, INCLUSIVE 5 OF LOAD AND BUMPERS, SHALL NOT BE MORE THAN FORTY FEET PROVIDED, HOWEV- 6 ER, THAT THE PORTION OF AN ATTACHED BOOM OR FORKLIFT THAT EXTENDS BEYOND 7 THE REAR BUMPER BY NOT MORE THAN FIVE FEET SHALL BE EXCLUDED FROM THE 8 MEASUREMENT OF THE LENGTH OF A SPECIALIZED MATERIAL DELIVERY VEHICLE. 9 FOR THE PURPOSES OF THIS PARAGRAPH, "SPECIALIZED MATERIAL DELIVERY VEHI- 10 CLE" SHALL MEAN A SINGLE UNIT TRUCK HAVING AN ATTACHED BOOM OR FORKLIFT 11 FOR THE PURPOSE OF HOISTING, SWINGING, LOADING OR UNLOADING MATERIAL 12 FROM SUCH TRUCK. THE PROVISIONS OF THIS PARAGRAPH AUTHORIZING THE EXCLU- 13 SION FROM THE MEASUREMENT OF THE LENGTH OF A SPECIALIZED MATERIAL DELIV- 14 ERY VEHICLE SHALL NOT APPLY UNLESS THE OPERATOR OF SUCH VEHICLE HOLDS A 15 VALID COMMERCIAL DRIVER'S LICENSE AS DEFINED BY SUBDIVISION ONE OF 16 SECTION FIVE HUNDRED ONE-A OF THIS CHAPTER. 17 S 2.
