PERSAUD, GOUNARDES -- read twice and ordered print- ed, and when printed to be committed to the Committee on Codes -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the penal law, in relation to unlawfully installing a gas meter The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The penal law is amended by adding a new section 270.40 to 2 read as follows: 3 § 270.40 Unlawfully installing a gas meter. 4 1. As used in this section "gas meter" means any gas meter that meas- 5 ures usage of any end use customer of gas services. 6 2. A person is guilty of unlawfully installing a gas meter when he or 7 she installs the gas meter or is the owner of the premises where the 8 meter is unlawfully installed and knows that such gas meter was unlaw- 9 fully installed. A gas meter is unlawfully installed when it is 10 installed by any person other than a person acting on behalf of a utili- 11 ty corporation subject to the jurisdiction of the public service commis- 12 sion, unless such person has received a permit to install the gas meter 13 from the appropriate permitting authority. 14 Unlawfully installing a gas meter is a class B misdemeanor. 15 § 2.
