       AN ACT to amend the education law, in relation to prohibiting on  campus
         residency as a requirement for scholarships, grants and awards offered
         by the state university of New York
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The education law is amended by adding a new section 141 to
    2  read as follows:
    3    S 141. SCHOLARSHIPS, GRANTS AND AWARDS; CAMPUS  RESIDENCY  REQUIREMENT
    4  PROHIBITED.  1.  NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO SCHOLAR-
    5  SHIP, GRANT, AWARD OR ANY OTHER FORM OF TUITION  ASSISTANCE  OFFERED  BY
    6  ANY  COLLEGE  OF  THE  UNIVERSITY, SHALL, AS A CONDITION OF ELIGIBILITY,
    7  REQUIRE THAT THE STUDENT RECEIVING SUCH  SCHOLARSHIP,  GRANT,  AWARD  OR
    8  ASSISTANCE  RESIDE ON CAMPUS IN CAMPUS HOUSING, EXCEPT WHERE SUCH SCHOL-
    9  ARSHIP, GRANT,  AWARD  OR  ASSISTANCE  IS  SPECIFICALLY  DESIGNATED  FOR
   10  ON-CAMPUS HOUSING OR BOARD.
   11    2.  NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PROHIBIT ANY COLLEGE
   12  OF THE UNIVERSITY FROM REQUIRING THAT A STUDENT BE  A  RESIDENT  OF  THE
   13  STATE  OF  NEW  YORK  IN  ORDER TO BE ELIGIBLE TO RECEIVE A SCHOLARSHIP,
   14  GRANT, AWARD OR ANY OTHER FORM OF TUITION ASSISTANCE.
   15    S 2. This act shall take effect July 1, 2011.
