STATE OF NEW YORK ________________________________________________________________________ 185--A 2017-2018 Regular Sessions IN SENATE (Prefiled) January 4, 2017 ___________ Introduced by Sens. MARCHIONE, DeFRANCISCO, FELDER, GALLIVAN, HELMING, ORTT, RITCHIE, SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT relating to rules and regulations of the state The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Every state agency, department, public benefit corporation, 2 or authority with legislative authorization to promulgate regulations 3 shall prepare and submit to the governor, temporary president of the 4 senate, speaker of the assembly, minority leaders of the senate and 5 assembly, commissioners of the Administrative Regulations Review Commis- 6 sion (ARRC), and the department of economic development, on or before 7 August 31, 2018, the following: 8 a. a comprehensive list of their adopted rules and regulations; 9 b. an explanation of the agency's or authority's need for the rule or 10 regulation; and 11 c. if no longer necessary, a recommendation for repeal. 12 § 2. On or before November 30, 2018, the department of economic devel- 13 opment shall review the lists developed pursuant to section one of this 14 act and make recommendations to repeal regulations that otherwise are an 15 impediment to economic growth and job creation. The department shall 16 consult with local and regional economic development entities prior to 17 issuing its recommendation. The chairpersons of ARRC shall likewise 18 review the lists developed pursuant to section one of this act and make 19 recommendations to repeal regulations that otherwise are an impediment 20 to economic growth and job creation. 21 § 3. a. On or before December 31, 2018, the governor shall identify at 22 least one thousand adopted rules or regulations to repeal, including any EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD02984-02-7S. 185--A 2 1 rule or regulation that is an impediment to economic growth and job 2 creation, which is not outweighed by substantial state regulatory inter- 3 est. The governor shall provide a copy of this list to the temporary 4 president of the senate, speaker of the assembly, minority leaders of 5 the senate and assembly, commissioners of the Administrative Regulations 6 Review Commission (ARRC), and the department of economic development. 7 b. Such rules and regulations identified for repeal shall be published 8 in the state register for a period of no less than forty-five days. 9 § 4. On or before April 1, 2019, the governor shall repeal at least 10 one thousand rules or regulations in accordance with established proce- 11 dure set out in subdivision 1 of section 202 of the state administrative 12 procedure act. 13 § 5. This act shall take effect immediately.
