        AN ACT to amend the state finance law and the labor law, in relation  to
          requiring the construction of certain parking facilities to be capable
          of supporting electric vehicle charging stations

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The state finance law is amended by adding  a  new  section
     2  19-a to read as follows:
     3    §  19-a.  Parking  facilities;  support  for electric vehicle charging
     4  stations.  1. For purposes of this section  the  term  "parking  garage,
     5  open  parking  lot  and/or  other parking facility" shall mean a parking
     6  facility of more than fifty parking spaces.
     7    2. Any construction project undertaken in  this  state  that  receives
     8  state  capital  funding and the scope of such project includes a parking
     9  garage shall be capable of supporting electric vehicle charging stations
    10  for a minimum of twenty percent of available parking spaces  through  an
    11  electrical  raceway to the electric supply panel serving the garage that
    12  shall be capable of providing a minimum of forty amps  and  two  hundred
    13  eight volts of electrical capacity to each charging station connected to
    14  it  with the raceway. Such raceway and all components and work appurten-
    15  ant thereto shall be in accordance with state, city and municipal  elec-
    16  trical codes.
    17    3.  Any  construction  project  undertaken in this state that receives
    18  state capital funding and the scope of such  project  includes  an  open
    19  parking  lot  and  other parking facility shall be capable of supporting
    20  electric vehicle charging stations through  an  electrical  raceway,  no

     1  smaller  than  one  inch, capable of providing a minimum supply of forty
     2  amps and two hundred eight volts to each electric vehicle supply  equip-
     3  ment  (EVSE)  from an electric supply panel. Such raceway and all compo-
     4  nents  and  work  appurtenant thereto shall be in accordance with state,
     5  city and municipal electrical codes.
     6    4. Nothing in this section shall require the installation of  electric
     7  vehicle  charging  stations  in  any parking garage, open parking lot or
     8  other parking facility.
     9    5. Any construction or  development  project  undertaken  pursuant  to
    10  subdivisions  two  and  three  of  this  section  shall  comply with the
    11  provisions of article eight of the labor law, including the payment of a
    12  wage of not less than the prevailing wage in  the  locality  where  such
    13  parking facility is located.
    14    §  2. Section 224-a of the labor law is amended by adding a new subdi-
    15  vision 4-a to read as follows:
    16    4-a. For purposes of this section,  any  construction  or  development
    17  project  undertaken  pursuant  to  section 19-a of the state finance law
    18  shall be considered a "covered project" and  shall  be  subject  to  the
    19  prevailing wage requirements in accordance with this article.
    20    §  3.  This act shall take effect immediately; provided, however, that
    21  section two of this act shall take effect on the same date  and  in  the
    22  same  manner as section 1 of part FFF of chapter 58 of the laws of 2020,
    23  takes effect.
