          Buttenschon, Englebright, Stern, Schmitt,  Kolb,  McDonough,  Woerner,
          Fahy,  McDonald,  Schimminger, Thiele, Montesano, Norris) -- read once
          and referred to the Committee on Housing -- committee discharged, bill
          amended, ordered reprinted as amended and recommitted to said  commit-
          tee

        AN  ACT in relation to defining residential construction as an essential
          business

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Notwithstanding any other provision of law, rule or regu-
     2  lation during the period of the COVID-19  state  disaster  emergency  as
     3  declared  pursuant to executive order 202 of 2020, and extensions there-
     4  of, and article  2-B  of  the  executive  law,  essential  business,  as
     5  provided  for  in  executive  order  202.6,  shall  include  residential
     6  construction not in excess of  three  stories,  notwithstanding  whether
     7  such construction is defined as affordable.
     8    § 2. This act shall take effect immediately.
