Brennan) -- read once and referred to the Committee on Judiciary AN ACT in relation to directing the president of the New York city economic development corporation to acquire the premises known as 589 Prospect Avenue in the borough of Brooklyn and providing for compen- sation therefor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Legislative findings and intent. The legislature hereby 2 finds, determines and declares that it is a matter of state concern and 3 in the interest of the people of the state to protect and provide a full 4 service supermarket in the Windsor Terrace section of the borough of 5 Brooklyn. The loss of the only such supermarket in the community has 6 severely impacted the lives of many senior citizens and others in the 7 community without cars who have no place they can walk to buy fresh 8 produce, meats and other staples. Therefore, the legislature finds and 9 declares that the proposed conversion of the property designated as lot 10 43 in tax block 1116, also known as 589 Prospect Avenue, in the borough 11 of Brooklyn, for use other than a full service supermarket would seri- 12 ously impact the health of these residents due to the limitation on what 13 food would be available to them without diverting part of their grocery 14 money for transportation to other communities. 15 S 2. The president of New York city economic development corporation 16 shall acquire, by purchase or condemnation, from the current owner, 17 pursuant to the eminent domain procedure law, the premises known as 589 18 Prospect Avenue. Furthermore, the president is hereby directed to issue 19 a request for proposals for a full-service supermarket to be operated at 20 this site through a long-term lease between the operator of the super- 21 market and New York city economic development corporation. Proceedings 22 for such acquisition shall commence immediately upon the enactment of 23 this article. 24 S 3. Just compensation for such purchase or condemnation shall be paid 25 to the current owner of the property in a manner consistent with the 26 eminent domain procedure law and other applicable laws. 27 S 4.
