        Introduced  by  COMMITTEE  ON  RULES -- (at request of M. of A. Peoples-
          Stokes) -- read once and referred to the Committee on Economic  Devel-
          opment

        AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
          license to sell liquor at retail for consumption on certain premises

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  (e-11)  of  subdivision 7 of section 64 of the
     2  alcoholic beverage control law, as added by chapter 280 of the  laws  of
     3  2019, is amended to read as follows:
     4    (e-11)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied as a  school,  church,  synagogue  or  other
     8  place  of  worship, provided such premises constitute a premises for the
     9  sale of food or beverages at retail  for  consumption  on  the  premises
    10  located  wholly within the boundaries of the county of Erie, bounded and
    11  described as follows:
    12    ALL THAT TRACT OR PARCEL OF LAND, situate  in  the  City  of  Buffalo,
    13  County  of  Erie  and  State  of  New York, and bounded and described as
    14  follows:  being part of Lot number  seventy-one  (71),  Township  eleven
    15  (11),  Range  eight  (8)  of  the Holland Land Company's survey and in a
    16  subdivision of part of said lots 71 and 72, made for  Main  Street  Land
    17  and  Improvement  Co., by C.F. Witmer, surveyor, a map of which subdivi-
    18  sion is on file in Erie County Clerk's  Office  under  Cover  292.  This
    19  premises  herby conveyed being designated as subdivision lot No. thirty-
    20  nine (39) in Block "C" and bounded and described as follows:
    21    BEGINNING at a point in the westerly line of  Main  Street  thirty-six
    22  and  one-half  (36-1/2)  feet  northerly  from its intersection with the
    23  northerly line of Heath Street (formerly Morton Street). Running  thence
    24  northerly  along  said  line  of  Main  Street  thirty-six  and one-half
    25  (36-1/2) feet; thence westerly at right angles with said  line  of  Main
    26  Street to a sixteen (16) foot alley; thence southerly along the easterly
    27  line  of  said  alley to a point where a line drawn at right angles with

     1  said line of Main Street would intersect said line of Main Street at the
     2  place of beginning and thence easterly at right angles with Main  Street
     3  to the said line of Main Street at the place of beginning.
     4    §  2.  This  act  shall take effect immediately and shall be deemed to
     5  have been in full force and effect on and after the  effective  date  of
     6  chapter 280 of the laws of 2019.
