STATE OF NEW YORK ________________________________________________________________________ 10540 IN ASSEMBLY May 31, 2016 ___________ Introduced by M. of A. OAKS -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to exempting teach- ers from additional certifications or prerequisites associated with running certain after-school programs The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 17 of the social services law is amended by adding 2 a new subdivision (h-1) to read as follows: 3 (h-1) grant any teacher certified in accordance with 8 NYCRR part 80, 4 an exemption from any additional certification or prerequisite, except 5 for background checks required under public law 113-186, required to 6 operate any after-school program operated by the office of children and 7 family services, or an after-school program for children run by a public 8 school district or by a private school or academy which is providing 9 elementary or secondary education or both, in accordance with the 10 compulsory education requirements of the education law, provided that 11 the kindergarten, pre-kindergarten, nursery school, or after-school 12 program is located on the premises or campus where the elementary or 13 secondary education is provided; except for any teacher working in any 14 school building of a city school district of a city having one hundred 15 twenty-five thousand inhabitants or more. 16 § 2. This act shall take effect on the sixtieth day after it shall 17 have become a law; provided, however, that effective immediately, the 18 addition, amendment and/or repeal of any rule or regulation necessary 19 for the implementation of this act on its effective date are authorized 20 to be made and completed on or before such effective date.
