Bill Title: Requires mandatory continuing education for cosmetologists and barbers; provides that during each four year license renewal period cosmetologists and barbers shall complete 36 hours of acceptable formal continuing education and shall be issued a certificate of completion to be submitted with their application for renewal of their cosmetology and/or barbering license.

STATE OF NEW YORK ________________________________________________________________________ 10457 IN ASSEMBLY April 23, 2018 ___________ Introduced by M. of A. WOERNER -- read once and referred to the Commit- tee on Economic Development AN ACT to amend the general business law, in relation to requiring continuing education for the practice of cosmetology and barbering The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding two new 2 sections 401-a and 432-a to read as follows: 3 § 401-a. Mandatory continuing education. 1. Each cosmetologist 4 licensed under this article shall comply with the provisions of the 5 mandatory continuing education requirements prescribed in subdivision 6 two of this section. Cosmetologists who do not satisfy the mandatory 7 continuing education requirements shall not practice cosmetology or be 8 issued a renewed license under this article. 9 2. During each four year license renewal period a cosmetologist shall 10 complete thirty-six hours of acceptable formal continuing education. 11 Four of such continuing education hours shall include training on recog- 12 nizing signs of domestic abuse and/or human trafficking. 13 3. Continuing education hours taken during one license renewal period 14 shall not be carried over or otherwise transferred to a subsequent 15 license renewal period. 16 4. As used in this section, "acceptable formal continuing education" 17 shall mean formal programs of learning provided by an accredited cosme- 18 tology school or by manufacturers or distributors of cosmetology 19 products. Such continuing education may include, but shall not be limit- 20 ed to, specialty color services, scissor and razor cutting techniques, 21 and cosmetology product knowledge. Such continuing education may be 22 conducted through an online course. 23 5. When a cosmetologist licensed under this article has fulfilled the 24 mandatory continuing education requirements pursuant to subdivision two 25 of this section, such cosmetologist shall be issued a certificate of 26 completion. A certificate of completion shall be submitted with every 27 application for renewal of a cosmetology license. A mandatory continuing education fee shall be forty dollars, shall 4 be payable on or before the first day of each four year license renewal 5 period and shall be in addition to the license renewal fee required by 6 subdivision one of section four hundred nine of this article. 7 § 432-a. Mandatory continuing education. 1. Each barber licensed under 8 this article shall comply with the provisions of the mandatory continu- 9 ing education requirements prescribed in subdivision two of this 10 section. Barbers who do not satisfy the mandatory continuing education 11 requirements shall not practice barbering or be issued a renewed license 12 under this article. 13 2. During each four year license renewal period a barber shall 14 complete thirty-six hours of acceptable formal continuing education. 15 Four of such continuing education hours shall include training on recog- 16 nizing signs of domestic abuse and/or human trafficking. 17 3. Continuing education hours taken during one license renewal period 18 shall not be carried over or otherwise transferred to a subsequent 19 license renewal period. 20 4. When a barber licensed under this article has fulfilled the manda- 28 tory continuing education requirements pursuant to subdivision two of 29 this section, such barber shall be issued a certificate of completion. A 30 certificate of completion shall be submitted with every application for 31 renewal of a barbering license. No renewal of a barber license shall be 32 issued without submission of such certificate of completion. 33 6. A mandatory continuing education fee shall be forty dollars, shall 34 be payable on or before the first day of each four year licensing 35 renewal period and shall be in addition to the license renewal fee 36 required by subdivision one of section four hundred forty of this arti- 37 cle. 38 § 2. This act shall take effect immediately.
