AN ACT to amend the social services law, in relation to directing the
commissioner of health to develop a standard prior prescription drug
authorization request form for managed care providers
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 364-j of the social services law is amended by
2 adding a new subdivision 26 to read as follows:
3 26. THE COMMISSIONER OF HEALTH SHALL DEVELOP A STANDARD PRIOR AUTHORI-
4 ZATION REQUEST FORM OR FORMS TO BE UTILIZED BY ALL MANAGED CARE PROVID-
5 ERS FOR PURPOSES OF SUBMITTING A REQUEST FOR A UTILIZATION REVIEW DETER-
6 MINATION FOR COVERAGE OF PRESCRIPTION DRUG BENEFITS UNDER THIS TITLE.
7 THE MANAGED CARE PROVIDER SHALL MAKE THE STANDARD PRIOR AUTHORIZATION
8 REQUEST FORM OR FORMS AVAILABLE TO, AND SHALL ACCEPT IT OR THEM FROM,
9 PRESCRIBING PROVIDERS IN PAPER AND ELECTRONIC FORM.
10 S 2. This act shall take effect immediately; provided, however, that
11 the amendment to section 364-j of the social services law, made by
12 section one of this act shall not affect the repeal of such section and
13 shall be deemed repealed therewith.
