CASTELLI -- read once and referred to the Commit- tee on Cities AN ACT to amend the state finance law, in relation to establishing temporary emergency financial aid to the city of White Plains and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The state finance law is amended by adding a new section 2 54-m to read as follows: 3 S 54-M. EMERGENCY FINANCIAL AID TO THE CITY OF WHITE PLAINS. 1. STATE 4 ASSISTANCE SHALL BE PAID DURING THE STATE FISCAL YEAR ENDING ON MARCH 5 THIRTY-FIRST, TWO THOUSAND ELEVEN, AND DURING THE STATE FISCAL YEAR 6 ENDING ON MARCH THIRTY-FIRST, TWO THOUSAND TWELVE, TO THE CITY OF WHITE 7 PLAINS, IN AN AMOUNT EQUAL TO ONE SIXTEENTH OF ONE PERCENT OF THE TOTAL 8 SALES AND COMPENSATING USE TAXES IMPOSED BY SECTIONS ELEVEN HUNDRED FIVE 9 AND ELEVEN HUNDRED TEN OF THE TAX LAW WITHIN THE TERRITORIAL LIMITS OF 10 THE CITY OF WHITE PLAINS DURING THE PRIOR STATE FISCAL YEAR. 11 2. THE MAYOR OF THE CITY OF WHITE PLAINS, IF HE OR SHE DESIRES TO MAKE 12 APPLICATION FOR STATE AID UNDER THIS SECTION, SHALL ANNUALLY ON SUCH 13 DATES AS MAY BE FIXED BY THE COMMISSIONER OF TAXATION AND FINANCE, 14 SUBMIT TO HIM OR HER THE REQUEST OF SUCH CITY FOR SUCH STATE AID AND 15 SHALL SUPPORT SUCH REQUEST WITH SUCH INFORMATION AS SUCH COMMISSIONER 16 MAY REQUIRE. THE COMMISSIONER OF TAXATION AND FINANCE SHALL PRESCRIBE 17 THE FORM IN WHICH SUCH INFORMATION SHALL BE SUBMITTED. 18 S 2. This act shall take effect April 1, 2010; provided, however, if 19 this act shall have become a law after such date it shall take effect 20 immediately and shall be deemed to have been in full force and effect on 21 and after April 1, 2010; provided, further, however, that the provisions 22 of section 54-m of the state finance law, as added by section one of 23 this act, shall expire and be deemed repealed at the close of the state 24 fiscal year ending on March 31, 2012.
