        AN ACT to amend the vehicle and traffic law, in relation to  the  opera-
          tion of bicycles with electric assist

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 8 of section 1242 of the  vehicle  and  traffic
     2  law, as added by section 8 of part XX of chapter 58 of the laws of 2020,
     3  is amended to read as follows:
     4    8. Except as may be otherwise provided by local law, ordinance, order,
     5  rule  or  regulation  enacted or promulgated pursuant to this article, a
     6  bicycle with electric assist may only be operated  on  highways  with  a
     7  posted  speed  limit  of  [thirty]  fifty-five  miles  per hour or less,
     8  including non-interstate public highways, private roads  open  to  motor
     9  vehicle traffic, and designated bicycle or in-line skate lanes.
    10    § 2. This act shall take effect immediately.
