STATE OF NEW YORK ________________________________________________________________________ 10092 IN ASSEMBLY April 29, 2022 ___________ Introduced by M. of A. NOLAN -- read once and referred to the Committee on Labor AN ACT in relation to establishing a commission to study and report on the implementation of paid family leave; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. A temporary state commission is hereby created to study and 2 report on the implementation of paid family leave, including how many 3 people have applied for and received paid family leave benefits, the 4 average use and payout of such benefits, and any issues with the program 5 and benefits. 6 § 2. The commission shall consist of eleven members, each to serve for 7 a term of one year, to be forthwith appointed as follows: three shall be 8 appointed by the temporary president of the senate and one by the minor- 9 ity leader of the senate; three shall be appointed by the speaker of the 10 assembly and one by the minority leader of the assembly; three shall be 11 appointed by the governor. By a majority vote, the commission shall 12 designate the chair and vice chair from among the appointees to the 13 commission. Vacancies in the membership of the commission and among its 14 officers shall be filled in the manner provided for original appoint- 15 ments. 16 § 3. The commission may employ and at pleasure remove such personnel 17 as it may deem necessary for the performance of its functions and fix 18 their compensation within the amounts made available therefor. 19 § 4. The commission may meet within and without the state, shall hold 20 public hearings, and shall have all the powers of a legislative commit- 21 tee pursuant to the legislative law. 22 § 5. The members of the commission shall receive no compensation for 23 their services, but shall be allowed their actual and necessary expenses 24 incurred in the performance of their duties hereunder. 25 § 6. To the maximum extent feasible, the commission shall be entitled 26 to request and receive and shall utilize and be provided with such 27 facilities, resources, and data of any court, department, division, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15437-01-2A. 10092 2 1 board, bureau, commission, or agency of the state or any political 2 subdivision thereof as it may reasonably request to properly carry out 3 its powers and duties hereunder. 4 § 7. The commission shall make a final report to the governor and the 5 legislature of its findings, conclusions and recommendations not later 6 than one year after the effective date of this act. 7 § 8. This act shall take effect immediately and shall expire and be 8 deemed repealed 1 year after such date.
