BRINDISI, TENNEY -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the parks, recreation and historic preservation law, in relation to designating a portion of state route eight in the town of Deerfield in Oneida county for snowmobile use THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 25.05 of the parks, recreation and historic preser- 2 vation law is amended by adding a new subdivision 1-c to read as 3 follows: 4 1-C. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS 5 SECTION, THE COMMISSIONER, WITH THE CONCURRENCE OF THE COMMISSIONER OF 6 TRANSPORTATION, MAY DESIGNATE FOR SNOWMOBILE USE A TRAIL WITHIN THE 7 RIGHT-OF-WAY OF STATE ROUTE EIGHT IN THE TOWN OF DEERFIELD IN ONEIDA 8 COUNTY BETWEEN MILE MARKER/AREA LOCATIONS ROUTE MARKER 8-2607-3237 AND 9 ROUTE MARKER 8-2607-3260. THE COMMISSIONER'S DESIGNATION SHALL INCLUDE 10 CONDITIONS, DEVELOPED IN CONSULTATION WITH THE COMMISSIONER OF TRANSPOR- 11 TATION, ON THE USE OF SUCH TRAIL BY SNOWMOBILES TO PROVIDE FOR THE SAFE 12 USE OF STATE ROUTE EIGHT AND THE SAFE OPERATION OF SNOWMOBILES ON THE 13 TRAIL. DESIGNATIONS MADE UNDER THIS SUBDIVISION SHALL BE EFFECTIVE FOR 14 NO LONGER THAN A PERIOD OF ONE YEAR AND MAY BE RENEWED WITH THE CONCUR- 15 RENCE OF THE COMMISSIONER OF TRANSPORTATION. 16 S 2.
