STATE OF NEW YORK ________________________________________________________________________ 9860 IN ASSEMBLY April 20, 2016 ___________ Introduced by M. of A. BUTLER, BLANKENBUSH -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development AN ACT to amend the parks, recreation and historic preservation law, in relation to designating a portion of state route twelve and a portion of state route twenty-eight in the town of Boonville in Oneida county for snowmobile use The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 25.05 of the parks, recreation and historic preser- 2 vation law is amended by adding a new subdivision 1-d to read as 3 follows: 4 1-d. Notwithstanding the provisions of subdivision one of this 5 section, the commissioner, with the concurrence of the commissioner of 6 transportation, may designate for snowmobile use a trail within the 7 right-of-way of state route twelve in the town of Boonville in Oneida 8 county between reference marker 12-2604-3212 and 12-2604-3213 and a 9 trail within the right-of-way of state route twenty-eight in the town of 10 Boonville in Oneida county between reference marker 28-2607-1142 and 11 28-2607-1143. The commissioner's designation shall include conditions, 12 developed in consultation with the commissioner of transportation, on 13 the use of such trails by snowmobiles to provide for the safe use of 14 state route twelve and state route twenty-eight and the safe operation 15 of snowmobiles on the trails. Designations made under this subdivision 16 shall be effective for no longer than a period of one year and may be 17 renewed with the concurrence of the commissioner of transportation. 18 § 2.
