STATE OF NEW YORK ________________________________________________________________________ 9800 IN ASSEMBLY February 9, 2018 ___________ Introduced by M. of A. WEPRIN -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to permitting boards of elections to change the date of a primary election if such election conflicts with a religious holiday The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 1 of section 8-100 of the 2 election law, as amended by chapter 17 of the laws of 2007, is amended 3 to read as follows: 4 (a) A primary election, to be known as the fall primary, shall be held 5 on the first Tuesday after the second Monday in September before every 6 general election unless otherwise changed by an act of the legislature 7 or unless otherwise changed by a board of elections within fourteen days 8 of such election if the election date conflicts with a religious 9 holiday. In each year in which electors of president and vice president 10 of the United States are to be elected an additional primary election, 11 to be known as the spring primary, shall be held on the first Tuesday in 12 February unless otherwise changed by an act of the legislature, for the 13 purpose of electing delegates to the national convention, members of 14 state and county committees and assembly district leaders and associate 15 assembly district leaders. 16 § 2.
