STATE OF NEW YORK ________________________________________________________________________ 9799 IN ASSEMBLY February 9, 2018 ___________ Introduced by M. of A. HUNTER, ENGLEBRIGHT -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to including the incorporation of solar panels in a project into a written cost-benefit analysis The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 4 and paragraph (b) of subdi- 2 vision 5 of section 859-a of the general municipal law, as added by 3 chapter 563 of the laws of 2015, are amended to read as follows: 4 (b) a description of the proposed project for which financial assist- 5 ance is requested, including the type of project, proposed location 6 [and], purpose of the project and how such proposed project will imple- 7 ment, to the fullest extent practicable and economically feasible, 8 resource conservation and energy efficiency measures and equipment 9 intended to reduce power demand and usage including solar panels, 10 utilize green technologies, and alternative and renewable fuels; 11 (b) a written cost-benefit analysis by the agency that identifies the 12 extent to which a project will create or retain permanent, private 13 sector jobs; the estimated value of any tax exemptions to be provided; 14 the amount of private sector investment generated or likely to be gener- 15 ated by the proposed project; the likelihood of accomplishing the 16 proposed project in a timely fashion; and the extent to which the 17 proposed project will provide additional sources of revenue for munici- 18 palities and school districts; whether the project incorporates solar 19 panels or other technologies to reduce carbon emissions; and any other 20 public benefits that might occur as a result of the project; 21 § 2.
