STATE OF NEW YORK ________________________________________________________________________ 9671 IN ASSEMBLY March 28, 2016 ___________ Introduced by M. of A. LALOR -- read once and referred to the Committee on Local Governments AN ACT to amend the town law and the public officers law, in relation to waiving the residency requirement for the town board-appointed offi- cers in the town of LaGrange, Dutchess county The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 23 of the town law is amended by adding a new 2 subdivision 30 to read as follows: 3 30. Notwithstanding the provisions of subdivision one of this section, 4 in the town of LaGrange, in the county of Dutchess, the persons perform- 5 ing the functions of town board-appointed officers, including, but not 6 limited to, the town building inspector, the comptroller, the accounting 7 officer, the dog warden, the municipal code enforcement inspector, the 8 stormwater management officer, the clerk of the works and the adminis- 9 trator of planning & public works need not be electors of such town. 10 Provided, however, the persons performing the functions of town board- 11 appointed officers, including, but not limited to, the town building 12 inspector, the comptroller, the accounting officer, the dog warden, the 13 municipal code enforcement inspector, the stormwater management officer, 14 the clerk of the works and the administrator of planning & public works 15 in any other town shall be electors of such town, unless otherwise 16 provided by an act of the state legislature. 17 § 2. Section 3 of the public officers law is amended by adding a new 18 subdivision 65 to read as follows: 19 65. In the town of LaGrange, in the county of Dutchess, the provisions 20 of this section requiring a person to be a resident of the political 21 subdivision or municipal corporation of the state for which he or she 22 shall be chosen or within which his or her official functions are 23 required to be exercised shall not prevent a person from holding any 24 town board-appointed office, including, but not limited to, the offices 25 of town building inspector, comptroller, accounting officer, dog warden, 26 municipal code enforcement inspector, stormwater management officer, 27 clerk of the works and administrator of planning & public works, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
