       AN ACT to authorize the New York state urban development corporation  to
         enter into agreements to develop a Cyber Research Institute
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Legislative Findings. The legislature finds that the  issue
    2  of  securing  networked  computer  systems  is of increasing importance.
    3  Governments at all levels, including the military,  private  businesses,
    4  and  individuals  have  increasingly become the targets of cyber attacks
    5  which range from theft  of  privileged  or  proprietary  information  to
    6  destructive  efforts  to  impede  or shut down systems which operate key
    7  elements of infrastructure, banking and business transactions, or  vital
    8  functions  of  government,  to  name  just a few. The increasing demands
    9  posed by this threat create a need for research and development  in  the
   10  area  of  cyber  security  in an environment which will allow pursuit of
   11  these studies in both an open academic setting and, also,  in  a  secure
   12  environment  for  classified  research.  The  United  States  Air  Force
   13  Research Lab at Rome, New York is presently conducting important work at
   14  its Information Assurance and Cyber Science Technology Laboratory. It is
   15  noted that several private businesses are  presently  engaged  in  cyber
   16  science work in close proximity to the Air Force Research Lab at Rome at
   17  the Griffiss Business and Technology Park, and several New York colleges
   18  and  universities  offer  undergraduate  and  graduate programs in cyber
   19  science and security. This combination of resources  uniquely  positions
   20  the  state of New York to become a leader in cyber security research and
   21  development.
   22    S 2. (a) The New York state urban development corporation shall under-
   23  take to establish, through public and private partnerships, which  shall
   24  include  the  Air  Force  Research  Laboratory  at  Rome, New York based

    1  colleges and universities, private businesses, and not-for-profit  enti-
    2  ties,  a Cyber Research Institute to be located at the Griffiss Business
    3  and Technology Park in Rome, New York.  Such institute shall be an inde-
    4  pendent not-for-profit corporation organized under the laws of the state
    5  of  New  York.  It shall be governed by a board of directors which shall
    6  have at least eight and not more than  twelve  members,  no  fewer  than
    7  three-quarters of whom shall be knowledgeable in fields directly related
    8  to  cyber  security or have ongoing engagement and responsibility in the
    9  cyber security industry or in industries where cyber security is  essen-
   10  tial  or  shall have experience in teaching, research or applied work in
   11  the area of cyber security in academic, business or government settings.
   12    (b) The New York state urban development corporation shall  work  with
   13  the  collaborating  businesses  and educational institutions, as well as
   14  the Griffiss Local Development Corporation, to ensure that a cooperative
   15  working relationship  is  established  between  those  institutions  and
   16  potential  participants of such research institute so that resources are
   17  made available and used in a responsible manner to support the  success-
   18  ful  development  of the proposed research institute and the creation of
   19  ongoing linkages between the  training,  research,  development,  demon-
   20  stration and technology transfer resources of the region's higher educa-
   21  tion  institutions, private sector businesses and the activities located
   22  at the Griffiss Business and Technology Park.
   23    S 3. This act shall take effect immediately.
