        AN ACT to amend the public health law, in relation  to  eliminating  the
          electronic  death  registration  system  fee for funeral directors and
          undertakers; and to repeal provisions of such law relating thereto

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Subdivision 1 of section 4148 of the public health law, as
     2  added by chapter 352 of the laws of 2013, is amended to read as follows:
     3    1. The department is hereby authorized and directed to design,  imple-
     4  ment  and  maintain an electronic death registration system for collect-
     5  ing, storing, recording, transmitting, amending, correcting and  authen-
     6  ticating  information,  as necessary and appropriate to complete a death
     7  registration, and to  generate  such  documents  as  determined  by  the
     8  department  in  relation  to a death occurring in this state. As part of
     9  the design and implementation of the system established by this section,
    10  the department shall consult with all persons  authorized  to  use  such
    11  system  to  the extent practicable and feasible. [The payment referenced
    12  in subdivision five of this section shall be collected for  each  burial
    13  or  removal permit issued on or after the effective date of this section
    14  from the licensed funeral director or undertaker to whom such permit  is
    15  issued,  in  the  manner  specified  by the department and shall be used
    16  solely for the purpose set forth in subdivision five of  this  section.]
    17  Except  as  specifically  provided in this section, the existing general
    18  duties of, and remuneration received by, local registrars  in  accepting
    19  and  filing certificates of death and issuing burial and removal permits
    20  pursuant to any statute or  regulation  shall  be  maintained,  and  not
    21  altered or abridged in any way by this section.
    22    §  2.  Subdivision  5  of  section  4148  of  the public health law is
    23  REPEALED.
    24    § 3. This act shall take effect immediately.
